License Agreement

Please read the license agreement carefully.

This license agreement (“License”) is a legal contract between you (“you”) and Themeber (“Themeber”, “we”, “us” or “our”). This document is part of our Terms of Use. By purchasing and using Themeber theme’s source code (the “Theme”), you agree to be bound by the terms of this License and the Terms of Use.

Allowed Uses

  • You may use the Theme on as many pages as you like on a single Tumblr account. However, you may not transfer the Theme between accounts.

  • You may use your purchased Theme for personal or commercial purpose for yourself or a client.

Restrictions

Unless you have been granted written consent from Themeber;

  • You may not transfer the Theme between Tumblr accounts.

  • You may not sub-license, resell, rent, transfer, or redistribute any portion of the Theme, or in any way state or imply that you created the Theme.

  • You may not copy or place the Theme on any website, or any other medium, modified or unmodified, that are available to users not covered by a license. You may store the Theme on non-public devices or storage systems for back-up.

  • Making modifications or alterations to the Theme does not free you to then sell, license or distribute them to anyone else.

Modifications

  • You may not modify, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the the source code of the Theme without Themeber’s prior written consent. However, you are allowed to modify the Theme with Tumblr’s Custom CSS Box.

  • You may not remove, hide, or modify any proprietary notices, such as the “Theme by Themeber” link, without Themeber’s prior written consent.

Ownership

When purchasing the Theme you effectively only purchase the right to use the Theme, not the actual piece of source code. You become a licensed user, not an owner of the Theme. You do not claim intellectual property right or exclusive ownership to the Theme, modified or unmodified. The Theme is the property of Themeber.

Guarantee

We test and optimize the Theme for the most common and modern web devices and browsers. We cannot and do not guarantee compatibility with all devices, browsers or third-party plugins. Device and browser compatibility should be tested against the Theme’s preview page. If for some reason the Theme is not working properly, report the issue to support@themeber.com, and we will do our best to resolve the problem.

Theme Updates

We update the Theme on a regular basis to maintain device and browser compatibility, make improvements, resolve problems, and sometimes we even add new features. You will always be informed via email when an update is available. All updates are free of charge.

Copyright

The Theme is copyrighted and contain proprietary information and trade secrets belonging to Themeber. Unauthorized copying or use of the Theme even if modified, merged, or included with other software, is expressly forbidden. You may be held legally responsible for any infringement of intellectual property rights that is caused or encouraged by your failure to abide by the terms of this License.

Third-Party

The Theme may contain third-party plugins and scripts that are explicitly licensed under their own license.

Termination

Themeber has the right to terminate your license immediately if you fail to comply with any term of this License. Upon termination, you must uninstall and/or destroy the Theme and all copies of it, including modified copies, if any.

Warranty Disclaimer

The Theme is provided “as is”, with all faults and without warranty of any kind, either expressed or implied. Themeber is not liable for any damages arising out of any defects in the materials. You agree to hold Themeber harmless for any result that may occur during the course of using, or inability to use this licensed Theme. In no case shall Themeber be liable for any damages including, but not limited to, direct, indirect, special, incidental or consequential damages, or other losses arising out of the use of or inability to use the Theme.

General Provisions

You agree to inform all users who have legitimate access to the Theme about the content of this License and to make sure that they comply with the terms of this License.

Changes to This License

We reserve the rights to make changes to this License without any prior notice. Any such changes will be reflected on this page.
